WITHIN THE SCOPE OF "PERSONAL DATA PROTECTION LAW"

CLARIFICATION TEXT FOR PROSPECTIVE EMPLOYEES

The Law on the Protection of Personal Data No. 6698 ("KVKK") published in the Official Gazette dated April 7, 2016 and numbered 29677, which aims to protect the fundamental rights and freedoms of individuals, especially the privacy of private life, in the processing of personal data. In accordance with Article 10 of the Law on the Protection of Personal Data No. 6697 published in the Official Gazette dated March 10, 2018 and numbered 30356 and the Communiqué on the Procedures and Principles to be Followed in the Fulfillment of the Obligation of Disclosure published in the Official Gazette dated March 10, 2018 and numbered 30356, we aim to inform you about your personal data processed by our Company Yıldız Pul Otomotiv Motor Parçaları Sanayi ve Anonim Şirketi ("Yıldız Pul" or "Company") with this Disclosure Text.

1. IDENTIFICATION OF THE DATA RESPONSIBLE

2. PROCESSED PERSONAL DATA

The following personal data are processed within the scope of your job application to Yıldız Pul;

·       Your Identity Information: name, surname, year of birth, gender, marital status;

·       Your Contact Information: address, e-mail;

·       Your Data on Education, Work and Professional Life: Last Graduated School Level, School Name, Year of Graduation, Language, Course and Certificate Information, Previously Employed Company and Duration of Employment, Position and Department, Reason for Leaving;

·       Health Information: Do you have a health problem (we only receive information in the form of yes or no to this question, no health data detail data is processed).

·       Other Information: Military Service Information, Criminal Record Information, Driver's License Information.

3. PURPOSES OF PROCESSING PERSONAL DATA;

Your personal data obtained within the scope of your relationship with Yıldız Pul is processed for the following purposes.

·       Evaluation of application processes and management of the recruitment process,

·       Sending job application forms and invitations by e-mail,

·       Conducting business negotiations,

·       Assessment of your suitability for the relevant position. 

4. TRANSFER OF PROCESSED PERSONAL DATA 

In line with the requirements of the relevant legislation and within the purposes specified in this Clarification Text, your personal data may be transferred to third parties within the framework of the following situations:

Legal Obligations:

• In cases stipulated by the relevant legislation, it may be shared with official institutions and competent authorities.

Internal Sharing:

• Within the scope of evaluating your job application and managing the recruitment process, it may be shared between the relevant departments and authorized personnel within the company.

Legal Basis of Data Transfer:

• Personal data transfers will be carried out based on the legal conditions stipulated by the relevant legislation and the explicit consent of the personal data owners.

Other Circumstances:

• Except for the cases stated above, your personal data will not be disclosed or transferred to third parties in any way.

Within the framework of the above-mentioned transfer situations, all necessary technical and organizational measures will be taken to protect the confidentiality of your personal data and to process it securely. 

5. METHODS AND LEGAL REASONS FOR COLLECTING PERSONAL DATA

In case you contact Yıldız Pul, your personal data is collected electronically and/or physically through the digital application form published in written or electronic media, the resumes of employee candidates sent to the Company via e-mail, cargo, fax, website channels, reference or similar methods, and employment or consultancy companies. Your personal data collected is processed for the purposes specified in this Clarification Text within the scope of the personal data processing conditions specified in Articles 5 and 6 of the Law, based on the legal reason of the performance of the contract regarding the evaluation and finalization of your job application.

6. RIGHTS OF THE DATA SUBJECT WHOSE PERSONAL DATA IS PROCESSED

In accordance with the provisions of Article 11 of the Law, you have the following rights in relation to your personal data;

·       To learn whether personal data is processed or not,

·       Request information if their personal data has been processed,

·       To learn the purpose of processing personal data and whether they are used for their intended purpose,

·       To know the third parties to whom personal data is transferred domestically or abroad,

·       To request correction of personal data in case of incomplete or incorrect processing,

·       Request deletion or destruction of personal data,

·        In case of correction, deletion or destruction of personal data, to request notification of these transactions to third parties to whom personal data are transferred,

·       To object to the emergence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems,

·       In case of damage due to unlawful processing of personal data, to demand compensation for the damage. 

7. IF YOU WISH TO CONTACT US FOR YOUR RIGHTS AND REQUESTS; 

In accordance with your legal rights stipulated in the relevant law and other legislation, you can submit your requests to our address above with a petition by hand or through a notary public. In addition, in accordance with Article 5 of the “Communiqué on the Procedures and Principles of Application to the Data Controller”, you can send your requests to [email protected] e-mail address by using registered electronic mail (KEP) address, secure electronic signature, mobile signature or the e-mail address you have previously notified to our Company and registered in our systems. 

Applications to be made within this scope will be accepted following the identity verification to be made by us, and your requests will be finalized as soon as possible and within 30 days at the latest, depending on the nature of the request.  If the process of responding to your application has an additional cost to Yıldız Pul, the fee in the tariff determined by the Personal Data Protection Board in the Communiqué on the Procedures and Principles of Application to the Data Controller will be charged.
